Electronic Acknowledgment of Civil Process Service Agreement

This agreement outlines the legally binding terms between the Client and 10-8 Protective Services, LLC (“Service Provider”) under which civil process services will be performed. By submitting this form electronically, the Client confirms full understanding and acceptance of all terms stated herein.

  1. Acceptance of Terms
    Electronic submission constitutes a legally enforceable contract under Ohio law. The Client affirms they have reviewed and agreed to all terms and conditions.
  2. Scope of Services
    All services are conducted in accordance with state and local legal standards. The Service Provider does not offer legal advice, representation, or consultation.
  3. Client Responsibilities
    Clients are responsible for submitting complete and accurate names, addresses, documentation, and service instructions. The Service Provider is not liable for service failure or delays resulting from erroneous or incomplete client input.
  4. Service Execution
    Each service level includes up to three documented attempts per individual and address. A basic notarized affidavit of service, non-service, or posting is provided at no additional charge.
  5. Confidentiality
    Client information and materials are treated with strict confidentiality and are used solely to fulfill requested services. 10-8 Protective Services, LLC adheres to applicable privacy and data protection regulations.
  6. Additional Charges
    Additional fees may apply for:
    – Designated time service: $65.00/hour
    – Multiple subjects or addresses: $65.00 each
    – Mileage beyond five miles: $0.70/mile
    – Detailed affidavits (upon request): $65.00
    – Late payments over 30 days: $50.00/month
    – After-hours service: $50.00
    – Holiday service: $100.00

  7. Cancellation & Refunds
    Cancellations made before service preparation are eligible for a refund minus a $5.00 administrative fee. No refunds will be issued once service preparation has begun or an attempt has been made.
  8. Court-Readiness Disclaimer
    Clients are solely responsible for ensuring the accuracy and legal sufficiency of documents submitted. The Service Provider is not responsible for delays or court rejection due to client error.
  9. Safety and Property Restrictions
    The safety of personnel is paramount. If a subject is aggressive, vulgar, or violent, service will be documented as non-service with no further attempts made and no refund issued.
    Service will not be attempted at properties clearly marked with “No Trespassing” signs unless the server is appointed under Ohio Revised Code 311.22.
    Failure to disclose known risks may result in legal and financial liability for injury or damages sustained by the Service Provider’s personnel.
  10. Payment Authorization
    The Client authorizes 10-8 Protective Services, LLC to collect payment for all agreed services and applicable charges. Payment is due upon receipt of invoice unless documented otherwise.
  11. Governing Law
    This agreement is governed by the laws of the State of Ohio. All disputes shall fall under the exclusive jurisdiction of courts in Mahoning County.
  12. Electronic Signature & Consent
    Submission of this agreement electronically signifies the Client’s intent to be legally bound, per the U.S. E-SIGN Act and Ohio’s Uniform Electronic Transactions Act (UETA). This digital submission is equivalent to a handwritten signature.
