When a process server delivers court papers in Ohio, the two most common methods are personal service and residence service. Both can be valid ways to complete service, but they work differently. Knowing the difference helps you understand what to expect and why your process server may attempt service in a particular way.

Personal Service

Personal service means handing the documents directly to the person named in the papers. It is the most direct form of service and leaves little room for dispute about whether the person received notice.

Personal service can often be completed wherever the person is found, such as at home, at work, or in another lawful location, subject to court rules and the server’s professional judgment. A server will identify the person and deliver the papers in a respectful, professional manner.

Residence Service

Residence service means leaving the documents at the person’s usual place of residence with a person of suitable age and discretion who lives there. For example, a server might leave papers with an adult family member or roommate who lives at the home.

Key points about residence service include:

  • The location must be the person’s usual residence, not just an address connected to them
  • The person accepting the papers must reside there
  • The person accepting the papers must be of suitable age and discretion

A server cannot simply leave papers with a visitor, a neighbor, or a child who is too young to understand their importance.

Which Method Is Better

Personal service is the most certain, but residence service can be just as valid when the requirements are met. Your attorney or the court may specify which methods are allowed in your case. Some situations, including certain subpoenas, may require personal service.

Why Accurate Information Matters

To complete residence service, the server must be confident that the address is the person’s current residence. Outdated addresses are a common reason for failed service. Skip tracing can confirm where a person actually lives before service is attempted.

Documenting the Service

For either method, the process server records the date, time, location, and details of the delivery, including a description of the person who received the papers. These details appear in the affidavit of service filed with the court.
