I certify that the personal identifiers provided on this form are accurate and I voluntarily and knowingly authorize the Ohio Bureau of Criminal Investigation (BCI) to conduct a criminal records check for information relating to me. I also voluntarily and knowingly authorize BCI to disseminate criminal arrest, conviction and juvenile delinquency adjudication records to the recipient named on my booking form. I voluntarily and knowingly release and discharge the Ohio Attorney General’s Office, BCI, Ohio Security & Investigations LLC, 10-8 Protective Services LLC and their employees from all claims and liability related to this authorized criminal record review and dissemination. This authorization and waiver is valid for one year.
Release of Liability, Assumption of Risk and Indemnification
1. Assumption of risk. I understand that I enter the property of Ohio Security & Investigations LLC and 10-8 Protective Services LLC at my own risk. I knowingly and voluntarily assume all risks of being on or near the premises, including parking lots, walkways, stairs and entrances, whether known or unknown.
2. Release and waiver. To the fullest extent permitted by law, I release, waive and forever discharge Ohio Security & Investigations LLC, 10-8 Protective Services LLC and their owners, members, officers, employees, contractors and agents (the “Released Parties”) from any and all claims, demands, damages, losses and causes of action of any kind, including claims for personal injury, slips, trips or falls, illness, damage to or loss of my vehicle or personal property, theft, and any other harm arising from my visit, my appointment or the services provided.
3. Background check results. The Released Parties only capture and transmit fingerprints and information. They do not control and are not responsible for the content, accuracy, timing, delivery, rejection or outcome of any background check, which are handled by the Ohio Bureau of Criminal Investigation, the FBI and the receiving agency. Fingerprints rejected for quality may need to be retaken, and agency fees are not controlled by the Released Parties.
4. Accuracy of information. I am solely responsible for the accuracy of the information, reason codes and recipient I provide. The Released Parties are not liable for delays, rejections, misdirected results or additional fees caused by incorrect or incomplete information.
5. Indemnification. I agree to indemnify, defend and hold harmless the Released Parties from any claims, damages, costs and attorney fees arising from my actions, my information, my guests, my vehicle or my breach of this agreement.
6. Limitation of liability. If any liability is found despite this release, the total liability of the Released Parties is limited to the amount I paid for the service.
7. Governing law and severability. This agreement is governed by the laws of the State of Ohio, and any dispute will be brought in the courts of Mahoning County, Ohio. If any part of this agreement is found unenforceable, the remaining parts stay in full effect, and the release will be enforced to the maximum extent allowed by law.
8. Video and audio recording. I understand and consent that Ohio Security & Investigations LLC and 10-8 Protective Services LLC record video and audio at all times inside their offices, and that these recordings may be kept and used for security, quality, safety and legal purposes.
9. Adults only; no guests. Only adults are permitted at our locations, and only the applicant may enter the office for the appointment. There is no need to bring anyone else. Anyone who comes with the applicant must wait in the hallway or outside in their vehicle.
10. No refunds. There are absolutely no refunds on appointments. All payments are final, including for missed appointments, late arrivals, cancellations, rejected or retaken fingerprints, and services not completed because of incorrect information or missing identification.
11. Electronic agreement. By checking the agreement box below and submitting this form, I confirm that I am 18 or older (or that my parent or guardian is agreeing on my behalf), that I have read and understand this agreement, and that my electronic acceptance has the same effect as a handwritten signature.
